SCOPE OF PRIVACY POLICY

Welcome to Akhbarwala. 

By using or accessing the Akhbarwala mobile Application (“platform” “application”) by opening an Account, it is acknowledged that the present Policy is accepted and it further consents that the Company will only collect, use, and will not disclose or share the personal data including any Sensitive Personal Information. This Policy is an electronic record in the form of an electronic contract formed under the Information Technology Act, 2000 (hereinafter referred to as “Act”) and the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011. (hereinafter referred to as “Rules”). 

This privacy policy explains our policy regarding the collection, use, disclosure, and transfer of your information by I MEDIA CORP LIMITED and/or its subsidiary(ies) and/or affiliate(s) (collectively referred to as the "Company"), which operates various websites/Mobile Apps & other services including but not limited to delivery of information and content via any mobile or internet connected device or otherwise (collectively the "Services"). This privacy policy forms part and parcel of the Terms of Use for the Services (“Terms of Use”). Capitalized terms which have been used here but are undefined shall have the same meaning as are attributed to them in the Terms of Use.

At Company, we believe that you are the owner of your data. When you choose to use our mobile application (“Platform”), you choose to share certain data with us that is necessary for us to provide our Services. We are indebted to you that you trust us with your data and assure you that we are committed to the highest levels to protect your data.

We want to ensure that you have complete control over the means and manner in which you wish us to process your data. We process your data based on your explicit consent and for a specified purpose as informed to you while seeking your consent. We are in strict compliance with the Act, its rules, and the Digital Personal Data Protection Act, 2023 (hereinafter referred to as “DPDP Act”) and other provisions under the Act and ensure that you lead the way you want us to process your data. We are also committed to comply with regulations under the Aadhaar Act, 2016 and its regulations and other mandates issued by the Reserve Bank of India (RBI) while processing your Aadhaar data and financial data respectively. We are also strongly committed to follow the principles held by the Supreme Court in K.S. Puttaswamy v. Union of India, with respect to consent sought from you while processing your data.

We have protection policy and system to protect your data. In addition to the applicable laws, we also adhere to reasonable security standards in the industry to ensure that you're aware of how we process your data at every step and stage.   

The Company herein is committed to protecting information of the user of its Services, in compliance with the Rules. The Privacy policy is divided into 3 parts – 

  1. Part I - Information received, collected, and stored by the Company.

  2. Part II – Processing of information by the Company. 

  3. Part III – General Terms of Privacy.

    • PART I - INFORMATION RECEIVED, COLLECTED AND STORED BY THE COMPANY    

Information under this Privacy Policy is same as defined in clause (v) of sub-section (1) of section 2 of the Act and includes Personal Information, as defined under clause (i) of Rule 2 of the Rules. The details about personal and information about data collected by us is as follows:

  1. Nature and Categories of Data that we collect. 

  2. Information supplied by users and

  3. Information automatically tracked while navigation,

  4. Information collected from any other source (collectively referred to as “Information”).

    • NATURE AND CATEGORIES OF DATA THAT WE COLLECT

You provide and we collect the following data from you, in order to provide you our Services:

  1. Account Data/Identity Data: When you create your account, we collect your name, sex, age, address, pin code, contact number, occupation and email address to enable you to sign-up and log-in to our Platform. In order to avail our Services, you might provide different data related to your Government IDs and other data related to you with us. We may also use this data to undertake two-factor authentication to verify your account whenever deemed required for confirming ownership of your account.

  1. Payment Data: We would provide you easy access to make payment wherein you will be required to provide data with respect to payment transaction data.

  1. Additional Data related to your Identity: We might require some non-compulsory information, such as photo, preferred language(s), and company name.

  1. Device Data: We under your consent collect your data related to your device such as device setting, geo-location data, contact details, SMS, access to internal storage etc only to provide you an improved experience for the user to avail services. Devices data may automatically be collected from you after your consent.

  1. Additionally, we may collect publicly available data limited to the reviews that you may give about our App or platform and may use it to provide improved experience for the user to avail services.

    • INFORMATION SUPPLIED BY USERS

Platform only collects Information that it needs. 

Information provided while registering an account - When the user registers on the application, Application and for the Service, we ask that they provide basic contact Information such as their name, sex, age, address, pin code, contact number, occupation, and email address which will enable us to provide them with our Services. Additionally, we might require some non-compulsory information, such as photo, preferred language(s), and company name. It will be up to the user’s discretion to provide us with such Information or not. The user will have to create a username and password for accessing the application, which will also be stored as Information. 

Payment details – The user will have to provide the application with payment information to enable payment to newspaper vendors, which includes card details, UPI IDs, and other payment account information. When you submit your card information, we store the name and address of the cardholder, the expiry date and the last four digits of the credit card number. We do not store the actual credit card number. For quick processing of future payments, if the user has given us approval, we may store your credit card information or other payment information in an encrypted format in the secured servers of our Payment Gateway Service Providers. When you submit your UPI ID, we only store the ID name, and link to the UPI application. We do not store UPI pin, or any other Information related to the account to which the UPI is linked. 

Information received via reviews and testimonials and other interactions – When the user gives their testimonials and reviews with respect to the services offered, and authorises the Company to publish them, the same may include their name and other personal information in the testimonial. However, the user can post their review or testimonial anonymously as well. If required, the user can contact our Services at email imediacorpltd.imcl.in or at +91-6261900271 to amend/review/delete such reviews or any personal information displayed with the review. 

We may record, analyse, and use the user’s interactions with us, including email, telephone, and chat conversations with our sales and customer support professionals, for improving our interactions with our customers.

    • INFORMATION AUTOMATICALLY TRACKED WHILE NAVIGATION

Browsers, Devices and Servers - When you visit our application, we collect information that web browsers, mobile devices and servers make available, such as the internet protocol address, browser type, language preference, referring URL, date and time of access, operating system, mobile device manufacturer and mobile network information. We include these in our log files to understand more about visitors to our application.

Cookies - To improve the responsiveness of the "Application" for our users, we may use "cookies", or similar electronic tools to collect information to assign each visitor a unique, random number as a User Identification ("User ID") to understand the user's individual interests using the identified computer. Unless you voluntarily identify yourself (through registration, for example), we will have no kind of way in knowing who you are, even if we assign a cookie to your computer. The only personal information which a cookie can hold is information you supply. A cookie cannot read data from your hard drive. Our advertisers may also assign their own cookies to your browser(s) (if you click on their ads), a process that we do not control. We receive and store certain types of information whenever you interact with us via Application(s) or Services through your computer/laptop/notebook/ mobile/tablet/pad/handheld device or any other electronic device capable of connecting to internet.

Log File Information - We automatically collect limited information about your computer's connection to the Internet, mobile number, including your IP address, whenever you visit(s) our application, or services. Your IP address is a number that lets computers attach you to the Internet and recognize where you sent data -For e.g., pages you viewed. We automatically receive and log information from your browser, including your IP address, your computer's name or your mobile phone details (“device details”), your operating system, browser type and version, CPU speed, and connection speed. We may also collect log information from your device, including your location, IP address, your device's details, and connection speed etc.

Clear GIFs - We may use "clear GIFs" (Web Beacons) to track the online usage patterns of our users in an anonymous manner, without personally identifying the user. We may also use clear GIFs in HTML-based emails sent to our users to track which emails are opened by them. We use this information to inter-alia deliver our web pages to you upon request, to tailor our Application or Services to suit the interests of our users, to measure traffic, to improve their quality, functionality and interactivity and let advertisers know the geographic locations from where our visitors come.

    • INFORMATION COLLECTED FROM ANY OTHER SOURCE - 

Sign Ups through authenticated Service Providers - When the user registers using your other web accounts like on Facebook, Instagram, Twitter, Gmail, Yahoo etc. we retrieve Information from such account(s) to continue to interact with the user and to continue providing the user with the Services.

Information from social media sites and other publicly available sources : When you provide feedback or reviews about our products, interact, or engage with us on marketplaces, review sites or social media sites such as Facebook, Twitter, LinkedIn and Instagram through posts, comments, questions, and other interactions, we may collect such publicly available information, including profile information, to allow us to connect with you, improve our products, better understand user reactions and issues, or to reproduce and publish your feedback on our application. PURPOSE OF COLLECTING INFORMATION

We use the collected information for the following purposes:

CHOICE OF INFORMATION 

If the user is sceptical about disclosure of certain Information to us, they may choose to do the following:

Disable cookies: You can disable browser cookies before visiting our application. However, if you do so, you may not be able to use certain features of the application properly.

Optional information: You can choose not to provide optional profile information such as your photo. You can also delete or change your optional profile information. You can always choose not to fill in non-mandatory fields when you submit any form linked to our websites.

In case you choose to decline to submit personally identifiable information on the Application, we may not be able to provide certain services on the Application to you. We will make reasonable efforts to notify you of the same at the time of opening your account. In any case, we will not be liable and or responsible for the denial of certain services to you for lack of you providing the necessary personal information.

When you register with the Application or Services, we contact you from time to time about updating of your personal information to provide the users such features that we believe may benefit / interest you. 

RIGHTS OF THE USER TO THEIR DATA

UPDATING PERSONAL INFORMATION

When you use the Services application etc (or any of its sub sites), we make good faith efforts to provide you, as and when requested by you, with access to your personal information and shall further ensure that any personal information or sensitive personal data or information found to be inaccurate or deficient shall be corrected or amended as feasible, subject to any requirement for such personal information or sensitive personal data or information to be retained by law or for legitimate business purposes. We ask individual users to identify themselves and the information requested to be accessed, corrected, or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, requiring disproportionate technical effort, jeopardizing the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes), or for which access is not otherwise required. In any case, where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort. Because of the way we maintain certain services, after you delete your information, residual copies may take a period of time before they are deleted from our active servers and may remain in our backup systems.

LIMITATIONS ON PERSONALLY IDENTIFIABLE INFORMATION

Any personally identifiable information provided by you will not be considered as sensitive if it is freely available and / or accessible in the public domain like any comments, messages, blogs, scribbles available on social platforms like Facebook, twitter etc.

Any posted/uploaded/conveyed/communication by users on the public sections of the "Application" becomes published content and is not considered personally identifiable information subject to this Privacy Policy.

    • PART II - PROCESSING OF INFORMATION BY THE COMPANY

The Information as supplied by the users enables us to improve Services and provide you the most user-friendly experience(s). In some cases/provision of certain service(s) or utility(ies), we may require your contact information as well. All required information is service dependent, and the Company may use the above said user Information to, maintain, protect, and improve the Services (including advertising on the "Application") and for developing new services. We may, however, use your email address without further consent for non-marketing or administrative purposes (such as notifying you of major changes, for customer service purposes, billing, etc.).

SMS POLICY

We are accessing SMS to read OTP only. We are not storing any content of other SMS. Our aim is to access SMS just for OTP auto read only.

SHARING OF SUCH PERSONAL DATA

Your data is stored with us and is only processed by us. We are a consent centric company and only share data with businesses that you provide your explicit consent for and do not enable sharing of your data with any third party without obtaining your explicit consent. We do not sell, rent or trade your data, we only share your data with your consent and the specific purpose for which you want us to share your data or as required for prevention of fraud or otherwise permitted by any applicable law.

We do not share any such personal Information with third party processors or contractors. However, if it is absolutely necessary to disclose such information with third parties, prior consent shall be taken from the user whose Information is to be disclosed as per Rule 6(1) of the Rules. 

In case data is required to be transferred to anybody corporate or any person on its behalf, the same shall be done in compliance with Rule 7 of the Rules. 

However, the Company shall have the liberty to share Information with Government agencies mandated under the law to obtain information including sensitive personal data or information for the purpose of verification of identity, or for prevention, detection, investigation including cyber incidents, prosecution, and punishment of offences, without prior consent of the user (Rule 6(1) of the Rules), as well as disclose such Information to any third party by an order under the law, without prior consent of the user (Rule 6(2) of the Rules).

    • PART III – GENERAL TERMS OF PRIVACY

INFORMATION SECURITY

  1. We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, including appropriate encryption and physical security measures to guard against unauthorized access to systems where we store personal data. All information gathered is securely stored within the Company controlled database. The database is stored on servers secured behind a firewall; access to the servers is password-protected and is strictly limited. However, as effective as our security measures are, no security system is impenetrable. We cannot guarantee the security of our database, nor can we guarantee that information you supply will not be intercepted while being transmitted to us over the Internet, and, of course, any information you include in a posting to the discussion areas is available to anyone with Internet access. That data collected from you is saved and stored on servers to avoid unauthorised access to it. We strictly adhere to security guidelines ensure to protect your data that is in our possession.

  1. We store your data over secure cloud service providers who offer security standards competitive with the industry norms. We also protect our servers by using SSL, and data access authorization controls. We take all the reasonable measures to preserve the integrity and security of your data that is in our possession.

  1. We have adopted all reasonable safeguards as mandated by the applicable law in order to protect your data. The data provided by you is stored only in the servers of India.

  1. Despite our best practices of safeguarding your data, you understand and accept that there is no guarantee that data transmission over the Internet will be completely secure and that any data that You transmit to Us is at Your own risk. We assume no liability for any disclosure of data due to errors in transmission issues, unauthorised third-party access to our Platform and databases or other acts of third parties or acts or omissions beyond our reasonable control and you shall not be entitled to hold Company responsible for any breach of security except in case of wilful negligence on the part of Company.

UPDATE/MODIFICATION OF PRIVACY POLICY

The internet is an ever evolving medium. We may alter our privacy policy from time to time to incorporate necessary changes in technology, applicable law or any other variant. In any case, we reserve the right to change (at any point of time) the terms of this Privacy Policy or the Terms of Use. Any changes we make will be effective immediately on notice, which we may provide by posting the new policy on the "Application". Your use of the Application or Services after such notice will be deemed acceptance of such changes. We may also make reasonable efforts to inform you via electronic mail. In any case, you are advised to review this Privacy Policy periodically on the "Application") to ensure that you are aware of the latest version.

Any complaint, abuse, or concern with regards to the processing of information provided by you or breach of these terms shall have to be immediately informed to the designated Grievance Officer/DPO

WHEN THIS PRIVACY STATEMEMTS APPLY

Its liability to the User is limited to those who have downloaded the application and logged in or has explicitly consented to the policy on any other product/service page offered to the User. By using the application, you agree to these terms and conditions. Any reliance you place on the app's information or services is at your own risk.

DISCLOSURES IN COMPLIANCE WITH LEGAL OBLIGATIONS

We may be required by law to preserve or disclose your personal information and service data to comply with any applicable law, regulation, legal process or governmental request, including to meet national security requirements.

RETENTION OF INFORMATION

We retain Personal Information only as long as the entity or user has an active Account or as permitted/required by applicable law. Generally, Personal Information is deleted upon the deletion of a related Account, unless required for legal compliance, fraud prevention, assistance in any inquiry or for any other purpose required under law and/or for any other purpose mentioned under the Act, Rules and DPDP Act.

ENFORCEMENT OF OUR RIGHTS

We may disclose personal information and service data to a third party if we believe that such disclosure is necessary for preventing fraud, spam filtering, investigating any suspected illegal activity, enforcing our agreements or policies, or protecting the safety of our users.

We make every effort, including periodic reviews, to ensure that personal information you provide is used in conformity with this Privacy Policy.
