Welcome to Akhbarwala, the Newspaper Business App (“We” “Our” “Us” “Company”) for Complete Billing & Collection Solutions! Before using the Akhbarwala mobile application (“the App” “Platform”), the user of the Platform (“you” “user” “your”) may please read these Terms of Use carefully. By accessing or using the App, you agree to be bound by these Terms.
These Terms of Use are to be read in conjunction with the Privacy Policy and any other documents referred to in these terms. Your use of the App is subject to your acceptance and compliance with the Privacy Policy.
The Company by way of the Platforms would strive to support small Merchants, Newspaper agents, Vendors, and Hawkers in managing customer relationships, billing, and record-keeping. The App provides tools for customer data management, account maintenance, effortless billing, flexible payment collection entries, and more. You may use the Services for your personal and business use or for internal business purpose in the organization that you represent.
This Agreement consists of the following terms and conditions (hereinafter the “Terms”).
By downloading and using the App, you acknowledge that you have read, understood, and agree to comply with these Terms of Use. If you do not agree with any part of these terms, you may not use the App.
You need to sign up for a user account by providing all required information in order to access or use the Services. If you represent an organization and wish to use the Services for corporate internal use, we recommend that you, and all other users from your organization, sign up for user accounts by providing your corporate contact information. In particular, we recommend that you use your corporate email address. You agree to: (i) provide true, accurate, current and complete information about yourself as prompted by the sign-up process; and (ii) maintain and promptly update the information provided during sign up to keep it true, accurate, current, and complete. You agree to use the App for its intended purpose and in compliance with all applicable laws and regulations. You will not use the App for fraudulent, disruptive, aggressive, manipulative, or any other inappropriate purposes. Company reserves the right to investigate and terminate your access if you violate these terms.
The user to avail the services of the App shall compulsorily provide the following information –
Name (In case of an organisation, name of the organisation)
Contact Details – (Phone/Email)
Address (Home/Work)
Payment Details – It is free for use by the users.
In addition to all other terms and conditions of this Agreement, you shall not:
attempt to gain unauthorized access to the Services or its related systems or network;
use the Services in any manner that could damage, disable, overburden, impair or harm any server, network, computer system, or any resource.
use the Services to send or store material containing software viruses, worms or other harmful computer codes, files, scripts, or programs.
use the Services in any manner that interferes with or disrupts the integrity, security or performance of the Services, its components and the data contained therein.
host, display, upload, modify, publish, transmit, store, update or share any information that belongs to another person or entity and to which you do not have any right, including personal or confidential information of any person or entity with respect to which you do not have consent or permission from such person or entity.
violate any applicable local, state, national or international law.
use the Services for any form of competitive or benchmarking purposes.
remove or obscure any proprietary or other notices contained in the Services.
use our Services in any manner that threatens the unity, integrity, defence, security or sovereignty of India, friendly relations of India with other countries, or public order, or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting other countries.
create a false identity to mislead any person as to the identity or origin of any communication; use the services for transmitting information that is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person; or (xviii) use the services in a manner that relates to or encourages any activity prohibited by law in India.
You agree to not use the application to send, use or reuse any material that does not belong to you; or is illegal, is offensive (including but not limited to material that is sexually explicit content or which promotes racism, bigotry, hatred or physical harm), deceptive, misleading, abusive, indecent, invasive of another's privacy, including bodily privacy, insulting or harassing on the basis of gender, blasphemous, defamatory, libelous, obscene, pornographic, paedophilic, or menacing; racially or ethnically objectionable, or disparaging; in breach of copyright, trademark, patent, confidentiality, privacy or any other proprietary information or right; or is otherwise injurious to third parties or relates to or promotes money laundering or gambling or promotes enmity between different groups on the grounds of religion or caste with the intent to incite violence; or is harmful to minors in any way; or impersonates another person; or threatens the unity, integrity, defence, security or sovereignty of India or friendly relations with foreign States or public order or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting other nation; or objectionable or otherwise unlawful in any manner whatsoever; or which consists of or contains software viruses or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource, political campaigning, commercial solicitation, chain letters, mass mailings or any spam.
As mentioned in our Privacy Policy, we do not engage in any third party sharing of data, nor encourage our users to do so.
Your privacy is important to us. Personal information you provide to us through the Service is governed by OUR Privacy Policy. Your election to use the Service indicates your acceptance of the terms of the Privacy Policy. Personal information provided to the App may be stored on servers in India and in any location where Company operates. Company may disclose personal information if required by law or government request, as specified in the Privacy Policy.

DATA OWNERSHIP
We respect your right to ownership of content created or stored by you. You own the content created or stored by you. Unless specifically permitted by you, your use of the Services does not grant us the license to use, reproduce, adapt, modify, publish or distribute the content created by you or stored in your user account for commercial, marketing or any similar purpose. But you grant us permission to access, copy, distribute, store, transmit, reformat, publicly display and publicly perform the content of your account solely as required for the purpose of providing the Services to you. When you no longer wish to use our Services, you can discontinue by deleting your data. The App and its content, features, and functionality are owned by Company. All intellectual property rights are reserved. You may not utilise any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation of any substantial parts of this Platform, without Company’s express written consent. You may also not create and/ or publish your own database that features substantial parts of this Platform without Company’s express written consent.
LIMITATION OF WARRANTY
Company does not represent that the Service is error-free, complete, or can be relied upon. THE SERVICE IS PROVIDED ‘AS IS’ AND ‘AS AVAILABLE’ WITH NO WARRANTY OF ANY KIND AND YOU ARE USING THE SERVICE AT YOUR OWN RISK. Company DISCLAIMS ANY WARRANTY, IMPLIED OR OTHERWISE, REGARDING THE SERVICE, INCLUDING WARRANTY OF MERCHANTS ABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
LIMITATION OF LIABILITY
UNDER NO CIRCUMSTANCES WILL THE COMPANY BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES (INCLUDING EMOTIONAL DISTRESS) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER OR NOT YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. UNDER NO CIRCUMSTANCES SHALL I MIDEA CORP LIMITED BE LIABLE TO YOU FOR ANY AMOUNT FOR SERVICES RENDERED PERSUANT TO THIS AGREEMENT.
These Terms of Use are governed by the laws of India and courts at Bhopal shall have jurisdiction for adjudication of any disputes.
USAGE RESPONSIBILITY
Users of Platform are responsible for the accuracy and security of their data input and stored within the app.
SERVICE AVAILABILITY
We strive to maintain the availability and functionality of Platform. However, we do not guarantee uninterrupted access to the app, and we reserve the right to suspend or discontinue access to the app at any time without notice.
We may modify these terms at any time by posting a new agreement. Your continued use of the App constitutes acceptance of the modified terms. Users are advised to check the Terms from time to time for regular updates.
TERMINATION AND REFUSAL OF SERVICE
Company reserves the right to terminate your access to the App at any time, for any reason, at its discretion.
